Wychavon District Council's Commercial Waste Service is a licensed waste carrier service and in order to comply with the Environmental Protection (Duty of Care) Regulations Act 1990 it is a requirement that a Duty of Care Waste Transfer Note is completed annually and retained on file for all our customers. It is a legal requirement to keep a copy of your completed Duty of Care Note for two years.
Under the Waste Regulations 2011, from 28 September 2011, Duty of Care Notes require the SIC 2007 code of the TRANSFEROR, that is, the business that is transferring the waste to another business. Please record your SIC 2007 code on your Duty of Care Notes.

What does it mean?
Waste producers are solely responsible for the care of their waste while they hold it. When you have waste you have a duty to stop it escaping, to store it safely and securely. Commercial waste must be collected by a licensed waste carrier.
Wychavon District Council is acting as the broker between yourselves (the producer of the waste) and FCC Environment Services (UK) Ltd formerly FOCSA (the carrier of the waste). When waste changes hands, a transfer note must be completed and signed by both parties and a written description of the waste handed over.
The council is obliged under the Duty of Care to collect and transport waste from the collection site to a disposal site safely and securely. The transfer note is a legal requirement and we are not able to collect your waste if it is not completed.
Description of the Waste
You must provide a description of the waste. This must include the European Waste Classification (EWC) six digit code. Most waste will fall within the codes listed below. If you are unable to identify your waste type please contact us for advice.
Please note we are unable to take the following:
- Sharps
- Corrosive substances
- Clinical waste
- Solvents
- Oil waste
- Builders rubble
- Acids
- Liquid waste
- Uncooked meat/offal
Alternative arrangements will need to be made for the removal of any of the above items or substances by calling the Environment Agency on 08708 506506.
Types of bins/sacks

Transfer (Office use)
For a property having a regular collection of the same type of waste, this transfer note will cover collections for one year from the date of application. If the type of waste alters in any way a new duty of care application must be submitted
A waste transfer note must be completed annually, and copies kept by both parties.
