Council Tax when someone passes away

We understand that dealing with Council Tax after someone has died can be difficult. This page explains what happens to Council Tax in different circumstances and when an exemption or discount may apply.

Tell us as soon as possible

Please let us know as soon as possible if the person responsible for paying Council Tax has died.

If you are registering the death, you can use the Tell Us Once service. This service shares the person's details with us automatically, so you do not need to contact us separately.

When you contact us, we will need the following details:

  • the name of the person who has died
  • the Council Tax account number (if known)
  • the property address
  • the date of death
  • details of anyone who still lives at the property
  • the name and contact details of the executor or person dealing with the estate
  • if the deceased was not the owner, the name and address of the property owner or landlord (if known).

Depending on your circumstances, we may ask for additional information, such as probate or letters of administration, once they have been granted.


  • What happens to Council Tax?

    The amount of Council Tax due depends on whether anyone still lives at the property and who owns it.

  • If someone still lives in the property

    If someone continues to live in the property as their sole or main residence after the death, a Council Tax charge will normally apply. The Council Tax account will be updated to reflect the new circumstances, and any discounts or reductions you may be entitled to will then be considered.

    In these circumstances:

    • the Council Tax account will be transferred to the remaining liable person, where appropriate
    • if only one adult remains liable, they may qualify for a 25% Single Person Discount (SPD)
    • if two or more liable adults remain, the full Council Tax charge will continue to apply.

    If the remaining occupants are on a low or limited income, you may also be eligible for Council Tax Support to help reduce your Council Tax bill.

  • If the property is now empty

    If nobody continues to live in the property following the death, what happens next depends on whether the deceased owned or rented the property.

  • The deceased was the sole owner

    If a property becomes unoccupied because the person liable for Council Tax has died, it may qualify for a Class F exemption. Where applicable, this provides a 100% Council Tax relief while the qualifying conditions continue to be met.

    The exemption applies where:

    • the deceased was the sole person liable for Council Tax
    • the property is unoccupied following their death
    • the property remains part of the deceased's estate.

    The exemption normally applies:

    • from the date of death until probate (or letters of administration) is granted; and
    • for up to six months after probate or letters of administration is granted, provided the property remains unoccupied and ownership has not changed.

    The exemption will end earlier if:

    • someone moves into the property
    • the property is sold or transferred to a new owner
    • the property no longer forms part of the deceased's estate.
  • The deceased lived alone but rented the property

    If the property becomes empty after the tenant dies, a Class F exemption may still apply whilst the estate remains liable to pay the rent.

    Once the tenancy ends or another person becomes liable for Council Tax, the exemption will end.

  • If the deceased did not own the property

    A Class F exemption does not apply simply because the person living in the property has died.

    If another person or organisation owned the property at the date of death (for example, a family member, a trust, a housing association or another owner), that owner may become liable for Council Tax once the occupier has died.

    As there is still a living liable person, the property does not qualify for a Class F exemption and a relevant charge will be applicable immediately.

    Examples include:

    • a property previously transferred into the name of a son or daughter
    • a property owned by trustees
    • jointly owned properties where the surviving owner remains liable.
  • If the property was jointly owned

    If the deceased jointly owned the property with another person who is still alive, the surviving owner usually becomes responsible for Council Tax immediately.

    If they continue to live at the property and are now the only adult resident, they may qualify for a 25% Single Person Discount. Otherwise, the full Council Tax charge will normally be payable.

    A Class F exemption does not apply because there is still a living liable owner.

  • If family members are clearing the property

    If family members visit the property to clear belongings or prepare it for sale, this does not count as occupation for Council Tax purposes.

    Provided nobody is living there and the qualifying conditions continue to be met, a Class F exemption can still apply.

  • What happens after probate?

    If a Class F exemption applies, it will continue until probate (or letters of administration) has been granted.

    Once probate has been granted, the exemption can continue for up to six months, provided that:

    • the property remains unoccupied
    • ownership has not changed through sale or transfer
    • the property remains part of the deceased's estate.

    After the exemption ends, Council Tax will become payable. The person responsible for paying the Council Tax will depend on the circumstances, for example the executor(s), personal representative(s) or the new owner.

  • Empty property premiums

    If the property remains unoccupied after the Class F exemption has ended, an empty property premium may apply, depending on how long the property has been empty and whether it is furnished.

    Where applicable, the premium is an additional 100% of the full Council Tax charge, meaning a total charge of 200% becomes payable.

    If the property remains substantially furnished after probate has been granted, the full Council Tax charge will become payable six months after the grant of probate (provided the property remains unoccupied and ownership has not changed). However, the property will be protected from the empty property premium for 12 months from the date probate (or letters of administration) is granted.

    If furniture is removed from the property during this 12 month period, it is important that you tell us the date this happened. This is because the property will be treated as empty and unfurnished from the date the furniture was removed, and this date is used to determine when an empty property premium may become applicable.

    If a property remains empty and unfurnished for 2 years or more, an empty property premium will normally apply. However, where the property formed part of a deceased person's estate, the legislation provides a 12 month period from the date probate (or letters of administration) is granted during which an empty property premium will not be charged, provided the property remains unoccupied.

    • probate or letters of administration has been granted
    • the property has been sold or transferred
    • someone moves into the property
    • furniture has been removed from the property.

Crisis and Resilience Fund Housing Payments (formerly DHP)

Crisis and Resilience Fund (CRF) Housing Payments (previously known as Discretionary Housing Payments) can provide additional financial support to people who currently receive Housing Benefit from Wychavon District Council or housing costs from the Universal Credit Department.

CRF Housing Payments can help with housing costs for those affected by:

  • the benefit cap
  • the Under Occupation reduction in social sector housing (14% reduction if under occupying by 1 bedroom or 25% if under occupying by 2 or more bedrooms)
  • Local Housing Allowance (LHA) restrictions
  • non-dependent deductions
  • costs associated with taking up a new tenancy, for example, removal costs and rent deposits.

You cannot apply for CRF Housing Payments to pay for:

  • The cost of things Housing Benefit or the housing element of Universal Credit deem ineligible e.g. utility costs, meals or personal care
  • Historic rent arrears
  • Overpayment deductions being made from your Housing Benefit or housing costs to pay back money previously overpaid to you
  • Council Tax charges.

How much help can I get?

The amount you receive and the length of time you are awarded help, depends on your personal circumstances. In some cases, we may not deem CRF Housing Payments suitable for your situation and may signpost you elsewhere for advice or assistance.

Wychavon District Council may be able to award payments for a short period, but we will often ask for additional steps to be taken by you to improve your circumstances and avoid reliance on this limited additional fund. These requests may include downsizing, moving to more affordable accommodation, considering a lodger, or reducing expenditure on non-essential items or subscriptions.

If your circumstances change, while you are in receipt of ongoing payments, you must inform us immediately as this could alter the amount we can continue to pay. 

CRF housing payments are short term awards only and therefore should not be relied upon for any length of time.

What does Wychavon District Council look at when deciding CRF Housing Payments?

When you apply, we'll look at:

  • your income, including any benefits you get
  • your savings
  • if you have any loans or debts
  • if there is anyone in your house that could help you to pay your shortfall 
  • if anyone in your house is ill or disabled
  • what you have done to try and pay your rent or housing costs
  • whether you are due money back from a former rental property deposit.

How can I apply for CRF Housing Payments?

You will be given the opportunity to upload your supporting evidence during the online application process. If you send an email, please ensure you include your name, address, and the application reference number provided to you when you completed the form. This is important, as it will mean we can easily link your email to your claim.

We aim to be in touch with a decision within 28 days of receiving your application wherever possible. It is important you supply us with supporting evidence to speed up the decision on your application.

What if I disagree with the decision?

You can write to us and ask us to review your application again within one month of the date of our decision and provide any additional supporting evidence that you think may affect the outcome of the initial decision. We will then write to you with the outcome of the review.

Please note that CRF Housing Payments are at Wychavon District Council's discretion and consequently there is no further right of appeal.

Other support from the Crisis and Resilience Fund

The Government has announced the Crisis and Resilience Fund (CRF) to help people facing financial crisis. The CRF is funded by the UK Government and will run for three years until 31 March 2029.

This national programme provides funding to councils in England to:

  • support residents who cannot meet essential costs such as food, energy, or household items
  • strengthen long-term financial resilience, helping households increase income, reduce expenses, and manage financial shocks
  • ensure support is fair, accessible, flexible, and based on individual need.

Support may include crisis payments such as cash payments, vouchers, essential household items, and access to preventative services.

We can send your Council Tax bill to you by email instead of by post.

The benefits of e-billing

  • You will receive your bill as soon as it is available.
  • It saves paper so is better for the environment.
  • It helps to reduce council spending by saving printing and postage costs.
  • You still have the option to print your bill or forward a copy to someone if you need to.

How to sign up for e-billing

There are three ways to sign up for e-billing:

3. Or you can call 03004 560 560 (charged at standard local rate) and ask to sign up for e-billing.

What happens next?

  • Once you have signed up for e-billing we will send future Council Tax bills to you by email unless you ask us to stop.
  • You must tell us if you change your email address.
  • We will contact you if our emails to you cannot be delivered because your email address is invalid.

Pay – Discounts and Exemptions – Help

Important information about your Council Tax

Keep an eye on your phones as we will be issuing our Council Tax bill and/or notification letter by text and email.

If we have your email address and mobile number, you will receive the following:

  • A text message from ‘Wychavon DC’ which will include a code you will need to enter online.

If you don’t click the link within a couple of days, we’ll send you a paper bill or notification in the post.

You’ll also receive a paper bill as usual if we don’t have your contact details.

  • Will I have reminders about my Council Tax bills?

    To help residents stay on top of when their Council Tax payments are due, we have started sending regular telephone/voicemail, email and text reminders to people who have fallen behind with their payments before the more formal notices are sent.

    The telephone/voicemail call will come from 03004 560560, our Council Tax telephone number.

    The text messages will come from ‘WychavonDC' and will read ‘You currently have an outstanding matter with South Worcestershire Revenues & Benefits Partnership who administer Council Tax on behalf of Wychavon District Council.’

    It then asks you to follow a link info.wychavon.gov.uk. Following that link will take you to a page with a security question to check your identity before giving you further instructions about your Council Tax account.

    The email will start with your name and Council Tax account number and will come from ‘This email address is being protected from spambots. You need JavaScript enabled to view it.’ and will include instructions as to what you need to do.

    If you receive any of these messages, we can confirm they are legitimate Wychavon District Council communications and ask you to act on the instructions detailed as soon as possible.
